Terms of Service

1. These terms

These terms are an agreement between you and Tapzy (“Tapzy”, “we”, “us”) for using tapzy.io, the Tapzy app and our free tools (together, “Tapzy”). By creating an account or using Tapzy, you agree to them. If you use Tapzy for a company, you agree for that company and confirm you may do so.

Our Privacy Policy explains how we handle personal data and is part of these terms.

2. Your account

• You must be at least 16 and give us accurate details.
• Keep your password safe. You are responsible for what happens in your account.
• Tell us at hello@tapzy.io if you think someone else has used your account.

3. Plans, trials and billing

• Free plan. You can use the free plan without a credit card. It has the features and limits shown on the pricing page, which we may change with notice.
• Free trial. When we offer a trial of a paid plan, it needs no credit card. When it ends, your account moves to the free plan unless you choose a paid one.
• Downgrades. If your plan ends or you move to a smaller one, your content stays. Features and limits of the new plan apply from then on: features it doesn't include pause until you upgrade again.
• Prices. Plans and prices are shown on the pricing page and at checkout. Taxes may be added where required.
• Renewal. Paid plans renew automatically each billing period until you cancel. You can cancel any time; your plan stays active until the end of the period you paid for.
• Payment providers. Billing runs through Stripe, PayPal or Dodo Payments. Their terms also apply to the payment.
• Changes. We will give you notice before a price change affects your next renewal.
• Refunds. Unless the law says otherwise, payments are not refundable. Contact us if something went wrong and we will look at it fairly.

4. Your content and your responses

You own what you create on Tapzy (forms, pages, links, QR codes, images) and the responses you collect. You give us permission to host, store, copy, display and send that content only as needed to run Tapzy for you, for example to show your form, deliver responses to your integrations and keep backups.

You can export your responses as CSV at any time. When you delete content or close your account, we delete it as described in the Privacy Policy.

5. Collecting data from others

When you collect answers, you are responsible for that data. In particular, you must:

• Tell respondents who you are and how you will use their answers, for example with a link to your own privacy policy.
• Have a lawful basis for what you collect, and get consent where the law needs it, including for any tracking tags you add.
• Only send SMS codes through a Twilio account you control and are allowed to use.
• Respond to people who ask to see or delete their answers. We will help where we can.

6. Acceptable use

Do not use Tapzy to:

• Phish, or collect passwords, full card numbers, or government ID numbers through forms.
• Send spam, or hide where a link really goes in order to mislead people.
• Share malware, or content that is illegal, hateful, harassing or that sexualises minors.
• Pretend to be another person or organisation.
• Break other people’s rights, including copyright and privacy.
• Probe, overload or get around the security of Tapzy, or access other people’s data. Security research is welcome through hello@tapzy.io.
• Resell or copy Tapzy without our written permission.

We may remove content, disable links or QR codes, or suspend accounts that break these rules, and we may report illegal activity.

7. Payments in your forms

Forms can take payment through your own Stripe or Dodo Payments account. The payment is between you and your customer, through that provider; Tapzy is not a party to it. You are responsible for your products, prices, taxes, refunds and disputes, and for following the provider’s terms.

8. Integrations and other services

Tapzy connects to services such as Google Sheets, HubSpot, Notion, Twilio, Meta Pixel, Google Tag Manager and webhooks you choose. Using them is optional and subject to their own terms. We are not responsible for those services or for what they do with data you send them.

9. Free tools

Our free tools (such as the QR code generator and UTM builder) are provided as they are, without an account and without a guarantee. Check anything you print or publish.

10. Changes and availability

We work to keep Tapzy running and improving. We may change or remove features. If we remove something important you pay for, we will tell you in advance. Tapzy may sometimes be unavailable for maintenance or reasons outside our control.

11. Ending the agreement

You can stop using Tapzy and close your account at any time. We may suspend or close an account that breaks these terms or puts others at risk. Where we reasonably can, we will warn you first and give you a chance to export your data.

12. Disclaimers

Tapzy is provided “as is” and “as available”. As far as the law allows, we make no promises that it will be error-free or uninterrupted, or fit for a particular purpose. Spam protection and verification reduce bad responses but cannot catch every one.

13. Limitation of liability

As far as the law allows, Tapzy is not liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

14. Indemnity

If someone makes a claim against us because of your content, your forms or how you use the data you collect, you agree to cover our reasonable costs and losses from that claim.

15. Governing law

These terms are governed by the laws of [to be confirmed], and disputes will be handled by its courts, unless the law where you live gives you the right to use your local courts.

16. Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, email account holders before they take effect. If you keep using Tapzy after that, the new terms apply.
